This course will provide an overview of how to properly arrange coverage for farm property, including dwellings, other farm and non-farm structures and personal property. We will also review the many endorsements available to tailor coverage based on the client’s loss exposures and their risk management strategy. We will then move on to discuss current issues with farm property insurance including the insurance marketplace, alternative risk funding mechanisms, changes in deductibles and retentions, parametric coverage, and the growing problem of underinsurance of farm property.

In this course, we will review the various farm liability coverage forms as well as commercial general liability forms with necessary modifications for farming operations. No liability course would be complete without a discussion of agritainment exposures and recreational use of farm land. We will then turn to a discussion of current issues in liability insurance, most notably social inflation, nuclear verdicts, the “billboard effect,” litigation abuse, and other topics having a continued impact on the insurance marketplace.

The liquor liability segment covers key legal sources, exclusions, and limitations in common policies, concluding with a review of ISO stand-alone forms vs. endorsements and non-insurance strategies to mitigate liquor-related losses.

The cannabis insurance segment examines the impact of changing laws on commercial and personal lines coverage, featuring an interactive case-study approach to real-world coverage challenges.

The final section of the seminar is based on a deceptively simple question: do the same principles of liquor liability apply to marijuana? Simply put, are the exposures the same?

This dynamic seminar offers a fast paced, interactive learning experience where participants work in groups to address real-world insurance and coverage-related scenarios. During part of this session, groups analyze actual cases, often involving coverage determinations, and present their decisions to the larger group for discussion. The outcomes of the real cases are then reviewed and debated. In another part of this session, participants collaborate to solve various coverage and insurance-related problems, scoring points by answering specific questions on rates, coverages, and causes of loss.

Seminar materials will be revealed as the class progresses rather than being available prior to class to retain the suspense give you the chance to work out the solutions as a group!

Summary

'If I had only known then what I know now...'

Case study and even mock trials are terrific teaching methods for keeping professionals engaged, but they suffer from a related pair of problems: (a) participants know there has to be a problem, or else there would not be a case to discuss; and (b) because there is a known problem, everyone has a bit of an omniscience or 20-20 vision before the fact.

This seminar tries to defeat this problem by intentionally creating a bit of a “fog of war” approach. Information is doled out to the participants in small increments and participants are left to speculate as to exactly what’s going wrong. In fact, some participants have expressed frustration due to the lack of information in the early stages but become more satisfied as more is revealed.

The seminar concludes with a discussion of the outcome of the case on which it is loosely based, and is tied to a comparison of what the participants thought at each stage the problem was going to eventually be.
